OVERVIEW
1. Scope
The following general terms and conditions apply exclusively to the business relationship between Andina Outdoors (hereinafter referred to as ANDINA OUTDOORS) and the customer of the online shop (hereinafter referred to as the customer) in the version valid at the time of the order. Deviating terms and conditions and/or other conditions of the customer are expressly rejected, regardless of their name, unless Andina Outdoors separately agrees to their validity in writing.
The content stored on www.decathlon.de is aimed at consumers who have their habitual residence in the Federal Republic of Germany, Austria, France, Italy, the Netherlands, Luxembourg or Belgium and who can provide a delivery address in this country. According to Section 13 of the German Civil Code (BGB), a consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.
2. Contractual partner, conclusion of contract
The purchase contract is concluded with ANDINA OUTDOORS.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after submitting your order, you will receive another confirmation by email.
3. Contract language
The language available for concluding the contract is German.
4. Order process
4.1 The presentation of the products merely represents an invitation to the customer to submit offers to conclude a purchase contract for the goods presented and is therefore not a legally binding offer.
4.2 The customer can select products from the Andina Outdoors range and collect them in a so-called shopping cart using the “add to shopping cart” button. If the customer clicks on the “Buy” button, he or she makes a binding offer to purchase the goods in the shopping cart.
4.3 The minimum value per order of any kind (gross value of goods including VAT excluding shipping costs or other costs; hereinafter “order value”) must be at least €10.00 and may not exceed €900.
4.4 Before sending the order, the customer can view and change the order data at any time using the “Shopping Cart” button.
4.5 The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. By clicking on the “Buy” button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order occurs together with acceptance of the order immediately after sending by an automated email. The purchase contract is concluded with this email confirmation.
We only deliver by mail.
5. Delivery conditions & shipping costs
5.1 We currently ship within Germany and to the following EU countries: Austria, France, Italy, Spain, Netherlands, Belgium and Luxembourg. Please note that the Rhine Islands in Germany cannot currently be delivered and, if necessary, please provide us with an alternative delivery address when placing your order. 5.2 In principle, delivery is carried out by the shipping company DHL. Items are only distributed in normal household quantities.
5.3 Delivery generally takes place against a shipping fee as stated in the respective offer.
5.4 The delivery time is approximately 1-3 working days, depending on the availability of the items.
5.5 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.
5.6 If delivery of the goods fails due to your fault despite three delivery attempts, we can withdraw from the contract. In this case we will inform you immediately. We will immediately reimburse you for any compensating measures already rendered.
6. Transport damage
If goods are delivered with obvious transport damage, please report such errors to the delivery person as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance company.
7. Warranty
If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the DHL employee who delivers the items. However, failure to make this complaint has no consequences for your legal rights. For all defects in the purchased item that occur during the statutory warranty period, the statutory claims for subsequent performance, for defect removal/new delivery and - if the legal requirements are met - the further claims for reduction or withdrawal as well as for compensation, including compensation for damage, apply at your discretion the fulfillment and reimbursement of your wasted expenses. If we grant you a seller's guarantee, the details can be found in the guarantee conditions that are attached to the item delivered. Guarantee claims exist without prejudice to legal claims/rights. If subsequent fulfillment is carried out by way of replacement delivery, the customer is obliged to return the goods delivered first to ANDINA OUTDOORS within 30 days at ANDINA OUTDOORS's expense. The defective goods must be returned in accordance with legal regulations. ANDINA OUTDOORS reserves the right to claim damages under the legally regulated conditions.
8. Prices
The prices mentioned are euro prices and include statutory VAT as well as all other price components and include shipping costs.

10. Retention of title
The goods remain the property of ANDINA OUTDOORS until full payment has been made.
11. Warranty and Guarantees
The statutory liability law for defects applies. Information about any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

13. Applicable law, place of jurisdiction
13.1 The law of the Federal Republic of Germany applies to all legal transactions or other legal relationships with ANDINA OUTDOORS.
13.2 In business transactions with merchants and with legal entities under public law, ANDINA OUTDOORS' place of business is agreed as the place of jurisdiction for all legal disputes regarding these terms and conditions and individual contracts concluded under them, including actions on bills of exchange and checks.
13.3 Online dispute resolution in accordance with Article 14 Para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/.
14. Disclaimer for third-party links
ANDINA OUTDOORS provides links to other sites on the Internet on its pages. ANDINA OUTDOORS expressly declares that it has no influence on the design and content of the linked pages. We therefore hereby expressly distance ourselves from all content on all linked third-party sites on www.decathlon.de and do not adopt this content as our own. This declaration applies to all links displayed and to all content of the pages to which links lead.
15. Copyright and trademark law
The entire content of the homepage, in particular texts, graphics, photos, illustrations, is the property of ANDINA OUTDOORS. This content is protected by copyright and other intellectual property rights. Reproduction, editing, storage or other processing is not permitted.
16. Image rights
All image rights belong to ANDINA OUTDOORS. Use without express permission is prohibited.
17. Revocation
You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
